TOUCHING AND CONCERNING REAL PROPERTY
Many people believe that the American Dream can be readily achieved with homeownership, and it is true that 65.4% of Americans own their homes. The investment in our home is generally recognized as the single largest investment that we will make in our lifetime. It’s not wonder that so many have concerns about property they own, or property they are thinking of buying. As Scafide Law, we help in both situations.
We regularly advise potential homeowners related to issues that may appear on a preliminary title report, such as easements and covenants. Often we are referred by realtors seeking to help their clients to get the information they need to scope issues related to a potential real estate transaction. Each of these are very sophisticated issues and our wealth of knowledge in this area has greatly benefited our clients who have often made the decision on whether to buy a particular property based on the advice rendered by members of our firm. Importantly, we will discuss with our clients the potential risks that any real-estate issue may present, but we recognize that we are advisors, and these decisions are the client’s to make. Armed with the best information possible, our clients understand the risks associated with a potential transaction, and make an informed decision. Our clients find that investing a few thousand dollars in legal fees to get the peace of mind associated with important information is well-spent when balanced against the significant investment (often more than a million dollars) in real estate. (For more information on these types of issues, click here to see our “Land Use” section of our page.)
At the same time, we represent current homeowners who face a plethora of issues with their homes. While the recent mortgage meltdown has slowed, many are still facing foreclosure and need help in dealing with lenders or loan servicers, and we can help in that regard. Members of our firm are highly adept with dealing with larger loan servicers in successfully negotiating agreements that allow our clients to keep their homes, sometimes with a lower monthly payment. We also assist clients with disputes with their neighbors, whether it is a view dispute or over an easement. Understanding the implications of each of the respective rights allows homeowners to reach the right decision.
Members of our firm are intimately familiar with unlawful detainer proceedings, having represented numerous landlords and tenants in both commercial and residential proceedings. Because of our keen understanding of the nature of the proceedings, and identifying areas where the process can be short-circuited, our clients have received the relief they seek in the most efficient manner.
We regularly review and negotiate commercial real estate transactions, as well, ranging from leases, purchasing, and investment documents. Our experience that is rooted in business law provides members of our firm with a keen understanding of the implications of transactions on both a real property as well as business perspective.
