TOUCHING AND CONCERNING REAL PROPERTY

Many peo­ple believe that the Amer­i­can Dream can be read­ily achieved with home­own­er­ship, and it is true that 65.4% of Amer­i­cans own their homes. The invest­ment in our home is gen­er­ally rec­og­nized as the sin­gle largest invest­ment that we will make in our life­time.  It’s not won­der that so many have con­cerns about prop­erty they own, or prop­erty they are think­ing of buy­ing.  As Scafide Law, we help in both situations.

We reg­u­larly advise poten­tial home­own­ers related to issues that may appear on a pre­lim­i­nary title report, such as ease­ments and covenants.  Often we are referred by real­tors seek­ing to help their clients to get the infor­ma­tion they need to scope issues related to a poten­tial real estate trans­ac­tion.  Each of these are very sophis­ti­cated issues and our wealth of knowl­edge in this area has greatly ben­e­fited our clients who have often made the deci­sion on whether to buy a par­tic­u­lar prop­erty based on the advice ren­dered by mem­bers of our firm.  Impor­tantly, we will dis­cuss with our clients the poten­tial risks that any real-estate issue may present, but we rec­og­nize that we are advi­sors, and these deci­sions are the client’s to make.  Armed with the best infor­ma­tion pos­si­ble, our clients under­stand the risks asso­ci­ated with a poten­tial trans­ac­tion, and make an informed deci­sion.  Our clients find that invest­ing a few thou­sand dol­lars in legal fees to get the peace of mind asso­ci­ated with impor­tant infor­ma­tion is well-spent when bal­anced against the sig­nif­i­cant invest­ment (often more than a mil­lion dol­lars) in real estate.  (For more infor­ma­tion on these types of issues, click here to see our “Land Use” sec­tion of our page.)

At the same time, we rep­re­sent cur­rent home­own­ers who face a plethora of issues with their homes.  While the recent mort­gage melt­down has slowed, many are still fac­ing fore­clo­sure and need help in deal­ing with lenders or loan ser­vicers, and we can help in that regard.  Mem­bers of our firm are highly adept with deal­ing with larger loan ser­vicers in suc­cess­fully nego­ti­at­ing agree­ments that allow our clients to keep their homes, some­times with a lower monthly pay­ment.  We also assist clients with dis­putes with their neigh­bors, whether it is a view dis­pute or over an ease­ment.  Under­stand­ing the impli­ca­tions of each of the respec­tive rights allows home­own­ers to reach the right decision.

Mem­bers of our firm are inti­mately famil­iar with unlaw­ful detainer pro­ceed­ings, hav­ing rep­re­sented numer­ous land­lords and ten­ants in both com­mer­cial and res­i­den­tial pro­ceed­ings.  Because of our keen under­stand­ing of the nature of the pro­ceed­ings, and iden­ti­fy­ing areas where the process can be short-circuited, our clients have received the relief they seek in the most effi­cient manner.
